Behaviour and training terms and Conditions

These terms and conditions are governed by and construed in accordance with the laws of England and Wales, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of England and Wales. Both parties will comply with all applicable laws and regulations.

These terms and conditions apply to all services (defined as home visits, field training visits, packages, meet and greets, virtual sessions, written summaries and all support email and phone conversations) by Samantha Bailey at K9Confidential Ltd to the exclusion of any other terms unless otherwise agreed in writing. We reserve the right to update these Terms and Conditions at any time by notice and with immediate effect. Services are only supplied in strict accordance with these terms and conditions. K9Confidential Ltd reserves the right to refuse to provide a service at its own discretion.

Signatures are not required to start a contract with K9Confidential Ltd; verbal communication, email, paying via CoachAccountable or other exchanges are legally binding. This includes the vet referral and as soon as booking has occurred you are agreeing to the following Terms and Conditions and services are charged to the client at the agreed amount. By agreeing to these terms and conditions your statutory rights are not affected. Should K9Confidential Ltd decide to waive any of these terms on an individual basis, this shall not affect the validity of remaining clauses or commit K9Confidential Ltd to waive the same clause on any other occasion.

Assessments and Training

The report from the consult will be shared with the referring veterinary surgery. K9Confidential Ltd shall provide the service for the use of the client only. The client may use the service provided only in its original form and only for its original use for the animal named and described within the vet referral or veterinary records supplied with a behaviour consultation, or from email correspondence for training and behaviour consultations. Informing your vet is a requirement before a behaviour consultation can begin and veterinary records can be supplied. In cases where a dog cannot have an examination the veterinary practice must still be informed.

K9Confidential Ltd will create a behaviour modification/training program related to the problems assessed and will make amendments to the behaviour program as required. These will only be amendments; if a new behaviour problem occurs a new consultation will be required. The client shall agree not to sell, destroy, deface, alter or part with work created by K9Confidential Ltd or permit it to be done so by a third party. Treatment plans for the most part will not be successful overnight. This requires a good deal of patience and client commitment and k9confidential ltd takes no responsibility for a clients lack of engagement. K9Confidential cannot guarantee that this will work, as each animal is an individual case, nor is it possible to foresee if another problem may arise as a result of the treatment. All programs are specific to a certain animal and should not be tried on any other animal. Clients must use all sessions within agreed timeframe on sign up.

Clients must ensure and are responsible for their dog's health before attending any training sessions. The client must inform us of any changes in health or diet prior to any sessions and of any illness in the household, human or pet. The Client must wear suitable footwear and clothing during sessions. If unsure, must contact us prior to the session.

Payment

Full Payment is required on booking a session or a support package deal. We can direct you towards credit plans if required but do not supply the plans ourselves. If payment has not been received within 72 hours of booking a date (when not using our online system), if using a secure payment link, you will be sent one reminder and if no response is received the appointment or package will be cancelled and if you wish to book again K9Confidential Ltd has the right to give a new quote. On receipt of payment a booking confirmation will be sent via email and a reminder 24 hours before your appointment. Please follow all the instructions to be sure the appointment runs smoothly. K9Confidential Ltd will not be held responsible for any problems arising from the client not following instructions given. K9Confidential Ltd reserves the right to cancel or change an appointment at any time by notice with immediate effect, without cause.

We cannot accept insurance directly. We recognise that insurance plans may have unique reimbursement criteria that may not align with our training structure. Our approach, focusing on crucial early assessment and implementation, differs from conventional per-session insurance coverage. We encourage clients to understand their insurance policies and discuss eligibility for our packages with their providers. Our method prioritises effective, long-term behavioural modification, contrasting with standard veterinary care where treatment is administered in each session. In our training, the initial sessions are key, with additional sessions designed to guide owners in implementing behaviour modification plans for their dogs. Clients are responsible for fully utilising these sessions according to their needs. To insurers, we emphasise the importance of upfront payment in allocating the necessary time and resources to fully implement the plan established in the first two sessions. We suggest that insurers consider payment after the completion of these initial sessions, aligning with many terms and conditions that stipulate payment post-treatment. This approach closely aligns with the terms and conditions of most insurance underwriters, ensuring a fair and effective payment structure for both parties.

Cancellations and Refunds

All deposits and any payments either part or full are non-refundable.

K9Confidential Ltd is a small company and will not able to offer refunds on any service unless there are extenuating circumstances.

If you need to reschedule an appointment or cancel an appointment you will be charged for the missed session except in exceptional circumstances.

If you did not use any additional visits paid for after an assessment or in a support package or any service they cannot be refunded or rolled over. It is the responsibility of the purchaser to book in the allotted sessions or to inform K9Confidential Ltd of any problems. No refunds are given after the payment has been received on an assessment or on any packages or services except in extenuating circumstances.

Weather Clause

In the interest of your pet's safety, if the temperature exceeds 25 degrees Celsius, it may be dangerous for your dog to participate in outdoor activities. In such cases, we reserve the right to reschedule sessions to ensure the well-being of your pet. We will notify you or you can notify us promptly if a session needs to be rescheduled due to extreme weather conditions.

Non-Communication and Package Cancellation Clause

In the event that we do not receive any form of communication from a client for a continuous period of 3 weeks following our last correspondence, we reserve the right not to extend the existing service package. Furthermore, we may choose to cancel the package entirely at our discretion. This measure is necessary to ensure the efficient allocation of our resources and the provision of high-quality service to all clients. Clients are encouraged to maintain open lines of communication with us to avoid such cancellations.

Alignment of Methods and Ethics in Behavioural Treatment

We pride ourselves on employing methods and ethics in behavioural treatment that are based on the latest research and best practices in the field. Our approach is designed to ensure the welfare and best possible outcomes for the animals in our care. To this end, it is crucial that any additional support or services procured by the client for their animal align with our ethical standards and methodologies.

Should the client choose to engage additional help that employs methods or practices contrary to our ethics and approach, we must express that we cannot guarantee the effectiveness of our treatment plans. Discrepancies in methodologies can lead to confusion for the animal and undermine the progress of our behaviour treatment programmes.

In instances where the engagement of such additional services is deemed by us to significantly conflict with the welfare of the animal or the integrity of our treatment approach, we reserve the right to discontinue our behavioural treatment services. This decision would be made with the welfare of the animal as our paramount concern and would be communicated clearly to the client. A refund or partial refund may be offered at K9Confidential Ltd discretion.

We encourage open dialogue about any additional services or support the client is considering, to ensure harmonious and effective collaboration towards the wellbeing of the animal.

Liability

Persons must be 16 or over, or be supervised by an adult for the training to go ahead.

K9Confidential Ltd holds public liability and care of custody liability insurance along with indemnity insurance.

K9Confidential Ltd shall have no liability under any circumstance whatsoever to the client for financial loss or loss of profit and will not be held responsible under any circumstances whatsoever to the Client for a lack of time, effort and circumstances where they did not follow any program created.

In no event will K9Confidential Ltd be liable to the client or any third party for damages or losses or be liable for any loss, injury or liability to the client. It is the client's responsibility to inform third parties of any possible risk. Nothing in these terms shall limit liability for death or personal injury caused by our negligence or for any other liability that cannot be excluded by law.

Clients agree to indemnify and hold K9Confidential Ltd harmless from any claims, damages, or losses arising from the training sessions or the use of our services.

K9Confidential Ltd is not liable for any injury or damage caused by the dogs during training sessions.

Behaviour and Field Responsibility Clause

K9Confidential Ltd reserves the right to immediately terminate access to the field or any services for clients who act in a dangerous, negligent, or non-compliant manner. No refund will be issued in such cases.

Dispute Reporting Clause

In the event of injury, damage, or other incidents, K9Confidential Ltd will report the matter to our insurers. Clients must cooperate fully in investigations.

Dispute Resolution

Any disputes relating to these terms and conditions will be resolved through mediation or arbitration before resorting to court action.

Third-Party Services

We use third-party websites for logins and payments. We are not responsible for any issues arising from these third-party services.

Force Majeure

K9Confidential Ltd shall not be liable for any failure to perform its obligations where such failure is due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, or other force majeure events.

Data Protection

Precautions are taken to ensure that your information is handled safely. We cannot, however, fully guarantee protection and in such an event we will not accept any liability of any loss thus caused. All financial information is erased after payment is received or payments are handled securely through Square, Stripe or PayPal.

We will not share or make available the information we hold on our database with any other company or organisation unless under court order.

Under the GDPR data protection law all the data you provide to K9Confidential Ltd is given by your consent and is of legitimate and vital interest and also to enable me to correspond with [clientFirstName] [clientLastName] during the support process. Your information is only shared or used in K9Confidential Ltd marketing with regards to our group of professionals called Succeeding Together to inform you of upcoming Q&A and events that may be of interest, you can unsubscribe by clicking on any email from Brevo or by contacting Samantha Bailey. All details are password and fingerprint protected and only Samantha and Rita Bailey have access to those details. Only Samantha has access to the personal details about you and your dog's training history. Your information will also be placed onto an automated reminder system (CoachAccountable and Supersaas) where you will receive username and password and to check what information we hold you can visit "your settings" on the sites or you can contact the data controller (Samantha Bailey) on 07734315829. Contents of any texts and emails are kept to keep track of your training history and are placed in session notes that you can view via Stream on CoachAccountable. You can request this information or deletion at any time by contacting Samantha Bailey. All CCTV footage, if training is carried out at the field, is held until recorded over except for insurance purposes where it is held for 7 years. K9Confidential ltd is a member of the ICO and you can request to see the certificate at any time. Any breach, once identified, is reported to Supersaas, the ICO and the police. But we do not hold any financial information; only email address, home address, name, phone number and details of your dog's training and behaviour history. You can request deletion of the account if you do not want these details to be held, but they are vital for you to be able to claim any insurance and will be held for 7 years. Any deletion requests will be completed within 28 days. If day training is involved, your keys are kept in a lock box and only venture out when I visit your property. No information on persons under the age of 16 years old is collected. An adult must supervise any training with a person under the age of 16.

Secure Dog Field Booking Additional Terms and Conditions

Access to the Field

Booking System Directions are sent on EVERY email you receive from the system. Please follow the map; the sat nav is not accurate.

Booking

Any professional/person making money/holding classes giving advice for non-profit, that wishes to use the field please contact us to inform us you have the correct insurance protecting you and your clients.

You can purchase credits through the online system to pay for your appointments. 1 credit gets a 30-minute session. You cannot book an appointment without credits in your account. You have exclusive use and this price includes up to ten dogs and 4 cars. For every ten credits you get your eleventh free. The credits for your free session add up as you purchase more credits. You can only book one session per day. And you can book up to 5 weeks ahead. If you want to book further ahead, K9confidential Ltd can book it for you if your account has credits. Please inform me if you give your appointment to somebody else; I will need a contact number. If you decide to cut your appointment short or do not turn up without informing K9confidential Ltd, you will still be charged for the full session booked. If you do not wish to use the online system you can book and pay over the phone. Payment is always required in advance.

GDPR and Data Protection

The GDPR data protection law came into effect on May 25th 2018. All the data you provide to K9confidential Ltd to use the Cricklade Secure Field is given by your consent and is of legitimate interest so you can receive entry codes and access to any free slots or toys for keeping the field poo free. It is also vital to have two contact details so we can reach you in an emergency, such as a field closure or sudden code change. Your Email and Name are also only used in K9confidential and Succeeding Together Newsletter advertising. All details are password and fingerprint protected and only Samantha, Rita, and John Bailey and Adam Togni have access while manning the phone during field hours. To check what information we hold you can visit "your settings" on the booking site or you can contact the data controller (Samantha Bailey) on 07734315829. Registered Guests Clause

The booking client is responsible for any additional guests and their behaviour. K9confidential Ltd reserves the right to cancel or refuse bookings for clients who bring unregistered attendees that cause disruption or damage and refuse new accounts if those people return to the field.

Refund Policy

If you make an appointment and cancel it yourself anytime over 24 hours in advance of your start time, the credits will automatically be put back onto your booking account to use for another time at the field. If you need to cancel within 24 hours of your start time you need to contact K9confidential Ltd on 07734 315829. K9confidential Ltd will put the credits back onto your online account for three times only for reasons of personal preference. I suggest if you are needing to cancel within 24 hours as you are unhappy with the field condition that you please do not book anything until the condition improves. The three cancellation limit rule does not apply when K9confidential Ltd have to cancel the slot, or when the weather is so bad that the river is at risk of flooding, or the field is very muddy and could cause injury, or if you have an emergency or unforeseen circumstance. Returning the cash value of credits into your bank or PayPal account is only offered when K9confidential Ltd need to cancel the appointment or in extenuating circumstances. Please be sure that the appointment you want is available before buying credits as no cash refunds are given except in extenuating circumstances. The credit/s remain in your account to use for another appointment. If you have been using the field and need to close the account please call K9confidential Ltd to discuss. If moving away or other circumstances where you can no longer use the field you will receive a full cash value refund of the remaining credits in your account (value depends on the package you purchased), not including any free credits that have been accumulated. This will be done by looking at your payment history and deducting any credits used then giving you the remaining value of the original payment that was used to purchase the credits. K9confidential Ltd reserves the right to refuse to provide a service at its own discretion.

Field Rules

Below are just a few rules to help keep you secure while using the field: Please only use the poo bags provided, they are hanging up on the left as you walk in and also hanging near the poo bins. We compost the poo and need to use these specific bags. We have biosecurity measures in place but I would recommend that your dog is immunised and you do not bring your dogs when they are ill. The gate code will be texted to your mobile phone. I would recommend keeping it on you during your visit. The field is appointment only and you have exclusive use of the field, so there are no other people or dogs inside the field or car park while you are using the field. There are 10-minute gaps between the end and start of each appointment to allow you time to leave before the other person arrives. You must leave the car park before the next appointment start time. If you arrived late to your appointment, you must still leave after your appointment slot is finished. Please contact me if you do arrive late and I can let you know if anybody is after you and extend the appointment if I can. Anybody who overstays more than three times will be banned from the field. If you arrive early and see a car in the car park or somebody using the field please remain outside and opposite the six foot silver gate. An area off the track has been levelled for this purpose. Once the other car has vacated the field, they will close the gate. If they stay past your start time and do not appear to be leaving, please call me on 07734315829. Once the field is vacated you can drive to the gate, input the code, swing the gate to the block (hook it up in windy weather) and it swings back and stops. Drive into the field and close the gate. You do not have to re input the code to close the gate, just gently push it closed. Please always drive into the field, we are not permitted to park outside the field, it is only a waiting area. The car area is has 6ft fencing so once the gate is closed and you can let your dogs out of the car. A disinfectant mat is provided to clean paws and shoes on entering and leaving. The inner gate has two locks, please use both to ensure the gate is totally secure on entry and exit. If anybody comes through the silver gate while you are using the field please call me immediately on 07734315829, as people need to wait outside. You have the use of the shack which has a toilet, first aid kit, umbrellas, towels and disinfectant. There is a rubbish bin on the left as you walk in, this is for food or toy rubbish. The bin near the entrance is only for dog poo. There is fresh water in the water butt and a watering can to wash down any loose poo. The equipment is for canine use only. We do not take any responsibility for any human injury caused by them using any equipment. On leaving the field, please always close the inner gates and the outer gate, even if somebody is waiting to come in. I ask everybody to do this to ensure everyone knows the code. The field has 6ft fences and is dug in by 1.5 ft in the inner field. However, if your dog is able to jump high fences the field will not be totally secure.
